Welcome to Niyabe. These Terms of Service ("Terms") govern your use of the Niyabe mobile application and related services (collectively, the "Service") operated by Niyabe ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

1. Acceptance of Terms

By creating an account or using Niyabe, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and Niyabe.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

To use Niyabe, you must:

  • Be at least 13 years old (or the minimum age required in your jurisdiction)
  • Have the legal capacity to enter into these Terms
  • Not be prohibited from using the Service under applicable law
  • Provide accurate and complete registration information
  • Maintain the confidentiality of your account credentials

If you are between 13 and 18 years old, you must have parental or guardian consent to use the Service.

3. Description of Service

Niyabe is a relationship tracking application that allows couples to:

  • Track relationship milestones and anniversaries
  • Create and share relationship timelines
  • Upload and organize photos and memories
  • Set relationship goals and track progress
  • Connect with their partner through the app
  • Receive insights about their relationship balance

4. User Accounts

Account Creation

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as necessary
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

Account Termination

You may terminate your account at any time by contacting us or using the account deletion feature in the app. We may terminate or suspend your account if you violate these Terms.

5. User Content and Conduct

Your Content

You retain ownership of content you upload to Niyabe, including photos, text, and other materials ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely to provide the Service.

Prohibited Content

You agree not to upload, post, or transmit content that:

  • Is illegal, harmful, threatening, abusive, or discriminatory
  • Contains nudity, sexually explicit material, or inappropriate content
  • Violates intellectual property rights of others
  • Contains personal information of others without consent
  • Is spam, commercial solicitation, or promotional material
  • Contains viruses, malware, or harmful code
  • Impersonates another person or entity

Prohibited Conduct

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Harass, abuse, or harm other users
  • Attempt to hack, breach, or circumvent security measures
  • Use automated scripts or bots to access the Service
  • Reverse engineer or attempt to extract source code
  • Create multiple accounts to evade restrictions
  • Share your account credentials with others

6. Partner Connections

Niyabe allows you to connect with a partner to share relationship content. By connecting with a partner:

  • Both users must consent to the connection
  • Shared content becomes visible to both partners
  • Either partner may disconnect at any time
  • You are responsible for obtaining consent before sharing partner information
  • We are not responsible for disputes between partners

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You acknowledge that by using the Service:

  • We may collect and process your personal data as described in our Privacy Policy
  • You consent to the storage and processing of your data
  • You are responsible for the privacy settings you choose
  • We implement security measures, but cannot guarantee absolute security

8. Intellectual Property Rights

Our Rights

The Service and all related content, features, and functionality are owned by Niyabe and are protected by intellectual property laws. This includes:

  • The Niyabe app, software, and technology
  • Our trademarks, logos, and brand elements
  • Design, layout, and user interface
  • Original content created by us

Respect for Third-Party Rights

You must respect the intellectual property rights of others. If you believe content on our Service infringes your rights, please contact us with details of the alleged infringement.

9. Subscription and Payments

Niyabe may offer premium features through subscription services:

Subscription Terms

  • Subscriptions automatically renew unless cancelled
  • Pricing is as displayed in the app or app store
  • You can cancel anytime through your app store account
  • Refunds are subject to app store policies
  • We may change subscription prices with notice

Free Trial

We may offer free trials for premium features. At the end of the trial, you will be charged unless you cancel before the trial ends.

10. Service Availability and Modifications

We strive to provide reliable service, but:

  • The Service may be temporarily unavailable due to maintenance or technical issues
  • We may modify, suspend, or discontinue features at any time
  • We are not liable for any interruption or modification of the Service
  • We will provide notice of material changes when possible

11. Disclaimers

The Service is provided "as is" and "as available." We disclaim all warranties, including:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties that the Service will be uninterrupted or error-free
  • Warranties regarding the accuracy or completeness of content
  • Warranties that the Service will meet your specific needs

Niyabe is not a substitute for professional relationship counseling or therapy. We do not provide professional advice regarding relationships, mental health, or personal matters.

12. Limitation of Liability

To the maximum extent permitted by law, Niyabe shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of data, profits, or business opportunities
  • Damages arising from your use or inability to use the Service
  • Damages related to third-party content or actions
  • Any amount exceeding the fees you paid in the 12 months prior to the claim

13. Indemnification

You agree to indemnify and hold harmless Niyabe, its affiliates, officers, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your User Content
  • Your violation of any third-party rights

14. Third-Party Services

Our Service may integrate with third-party services (such as cloud storage, analytics, or social media). These third-party services:

  • Are governed by their own terms of service and privacy policies
  • Are not under our control
  • May collect information independently
  • Are not endorsed or guaranteed by us

15. Geographic Restrictions

The Service is operated from the United States. We make no representation that the Service is appropriate or available for use in other locations. If you use the Service from other jurisdictions, you are responsible for compliance with local laws.

16. Children's Safety

We are committed to protecting children's privacy and safety:

  • Users under 13 are not permitted to use the Service
  • We do not knowingly collect information from children under 13
  • Parents should monitor their children's use of the Service
  • If we learn that a child under 13 is using the Service, we will terminate the account

Informal Resolution

Before filing a formal dispute, please contact us at support@niyabe.com to try to resolve the issue informally.

Binding Arbitration

Any disputes that cannot be resolved informally will be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in English and located in the United States.

Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

18. Governing Law

These Terms are governed by the laws of the United States and the state where our company is incorporated, without regard to conflict of law principles.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Niyabe regarding the Service.

21. Updates to Terms

We may update these Terms from time to time. When we do:

  • We will post the updated Terms on this page
  • We will update the "Last updated" date
  • We may notify you through the app or by email
  • Your continued use constitutes acceptance of the new Terms

If you do not agree to the updated Terms, you must stop using the Service.
